Landlords have been advised to act now to get rid of anti-social tenants before changes to tenancy legislation come into force next year. Tenant groups have not noticed an increase in evictions, but are seeing more people handed rent increases ahead of the end of the six-month Covid-19 rent freeze. The Residential Tenancies Amendment Bill passed last month will end “no-cause” evictions under which a landlord can end a periodic tenancy for any reason with 90 days’ notice, or 42 days if they are selling the property. From February, landlords will have to give a reason to end the tenancy – including selling the property, repeated rent arrears, or for a new “anti-social” behaviour clause which will be ruled on by the Tenancy Tribunal. Otago Property Investors Association president Kathryn Seque advised members to act now if they wanted to evict a difficult tenant.
